Spain’s highest court has removed the last immediate legal obstacle to the Sánchez-government’s extraordinary regularisation programme that could grant work and residence permits to an estimated 500,000 undocumented migrants. In two rulings issued on 28 May 2026, the Administrative Chamber of the Tribunal Supremo refused to suspend the April Royal Decree that created the fast-track scheme.

Far-right party Vox and the Community of Madrid had argued that the plan would distort the electoral roll and collapse public services. Five of the seven justices disagreed, noting that neither claim was supported by evidence and that any demographic impact would be gradual. Once approved, beneficiaries receive a provisional NIE number and immediate work authorisation while their full residence card is processed. Employers, especially in agriculture, construction and domestic care, are already preparing recruitment pipelines, and social-security officials expect up to €1 billion in additional annual contributions if the full half-million are regularised.
