Brazil issues updated 2026 guidance for Digital-Nomad (VITEM XIV) visa applicants
On 10 May 2026 the São Paulo immigration boutique ZS Advogados published a fully-revised practitioners’ guide to Brazil’s Digital-Nomad visa (VITEM XIV), incorporating the most recent changes to Normative Resolution 45/2021 and the new electronic filing interface that the Ministry of Justice quietly soft-launched in April.

For travelers or HR teams who need an at-a-glance way to verify Brazilian entry requirements or initiate paperwork, VisaHQ’s Brazil portal (https://www.visahq.com/brazil/) offers up-to-date information on the Digital-Nomad visa alongside other categories; the platform can pre-screen documents, calculate fees and even coordinate courier submission, smoothing what can otherwise be a cumbersome process.

The update confirms three practical points that had been unclear to mobility managers. First, proof of income can now be shown either through six months of bank statements or by presenting a single consolidated annual tax return, provided it demonstrates monthly income of at least US $1,400 or savings of US $17,000. Second, dependants may file “piggy-back” applications entirely online once the principal applicant’s Federal Police protocol number is issued, eliminating a second consular appointment. Third, applicants who enter Brazil visa-free (or on the soon-to-re-introduced e-Visa for U.S./Australian/Canadian nationals) may now convert to Digital-Nomad status in-country without leaving and re-entering, as long as the online petition is lodged within 30 days of arrival. Behind the scenes, the National Immigration Council (CNIg) has told industry associations that it intends to publish a consolidated ordinance later this year bringing together the Digital-Nomad, Start-up and Tech-Talent visas under a single “remote productive activities” chapter. The move is designed to simplify compliance for companies that rotate teams through Brazil for short innovation sprints or hybrid work assignments. Corporations should nevertheless continue to monitor municipal tax obligations: under the so-called economic nexus rules, a foreign employer with more than 183 person-days of remote work annually in Brazil could be deemed to have created a taxable permanent establishment. For HR and global-mobility teams the new guidance is timely. Interest in Brazil as a base for distributed teams has taken off since the real slipped below R$5 to the dollar, making cost-of-living allowances extremely competitive compared with Mexico City, Lisbon or Madrid. ZS Advogados estimates that weekly Digital-Nomad consultations have doubled since January, with clients in gaming, fintech and creative industries leading demand. Companies are advised to build at least six weeks into project timelines to accommodate Federal Police scheduling backlogs in hubs such as São Paulo and Florianópolis. Practical tip: applicants should upload colour scans no larger than 5 MB each; files that exceed the limit are still the main cause of rejection "for technical reasons". Mobility managers should also remind travellers that local private health-insurance policies must show coverage across all 26 states and the Federal District—a point consulates increasingly verify before stamping the visa. Failure to demonstrate nationwide cover has resulted in several refusals this quarter, according to practitioners.
