The scheme—authorised by Royal Decree 316/2026—offers a one-year renewable residence-and-work permit to undocumented migrants who can prove they lived in Spain before 1 January 2026, have at least five months’ continuous presence and hold a clean criminal record. Most early applications used qualified electronic certificates via the Mercurio platform and were lodged by lawyers, accredited NGOs and social-service bodies registered in the RECEX collaborator system. The government expects up to 750,000 filings by the 30 June cut-off, though officials admit about 30 percent may ultimately be refused. Face-to-face processing begins on 20 April at more than 450 social-security, postal and immigration offices nationwide. For business, the regularisation could inject hundreds of thousands of workers into Spain’s formal labour market just ahead of the summer tourism high-season and the 2026–27 harvest cycle. Hospitality, agriculture and elder-care employers are already signalling interest in hiring newly documented staff. Yet unions warn that understaffed offices and legacy IT systems risk bottlenecks; backlogs could delay NIE issuance and, by extension, onboarding of candidates. Corporate mobility managers should advise undocumented employees to gather proof of pre-2026 residence—utility bills, padron certificates, medical appointments—well before appointment dates. Companies sponsoring workers through the scheme can use Spain’s online ‘Representa’ portal to file as authorised representatives, but must store copies for a minimum of five years in case of audit.
