Dáil passes landmark International Protection Bill, ushering in the biggest overhaul of Ireland’s asylum system in decades
In a late-night vote on April 15, 2026, the Dáil approved the International Protection Bill 2026 by 86 votes to 62, sending the measure to President Catherine Connolly for signature. The 380-page Bill consolidates and rewrites Ireland’s asylum legislation to bring it into line with the European Union Migration and Asylum Pact ahead of the EU’s June 6 implementation deadline. Ministers describe the reform as the most significant change to Irish immigration law since the 1990s and say it will create a faster, more rules-based system while deterring unfounded claims.

At the heart of the legislation is a new screening procedure that every applicant will undergo immediately on arrival. Biometric data will be recorded and run through the Eurodac database, and applicants will receive information on their rights and duties before being allocated to one of four tightly-timed decision tracks. The inadmissibility and accelerated tracks must conclude within two and three months respectively, while a new border procedure—intended to be carried out in dedicated facilities at ports and airports—imposes a 12-week limit for first-instance decision, return order and appeal. Even the ordinary procedure is capped at six months, a sharp contrast with today’s average processing time of two years.

The reform aligns Ireland with EU partners on issues such as safe-third-country rules, mandatory use of Eurodac biometrics and a common returns framework. It also gives domestic effect to the EU’s solidarity mechanism, under which Ireland will either relocate a set quota of asylum seekers from frontline member states or make a compensatory financial contribution. Officials argue that harmonisation will reduce so-called “asylum shopping” and secondary movements into Ireland, a particular concern because of the open land border with the UK.

Whether you are an employer, relocation specialist, or individual traveller, VisaHQ can help you navigate the rapidly changing Irish immigration landscape. Our platform (https://www.visahq.com/ireland/) provides up-to-date guidance, document checks, and end-to-end application support for Irish visas and residence permits, ensuring that clients stay compliant as the new rules come into force.

For employers, the Bill promises greater predictability around the status of prospective hires who are in the protection process and should eventually reduce the State’s €1 billion-a-year bill for emergency accommodation, easing pressure on the housing market that affects corporate relocations. However, business and NGO representatives warn that the sharply reduced timelines will only work if the International Protection Office and newly created appeals tribunal receive the staffing and digital resources promised in the accompanying implementation plan. Companies that rely on talent pipelines from humanitarian routes—especially in ICT and healthcare—should prepare for more stringent identity checks and shorter windows to regularise status.

Next steps include a constitutionality review by the President’s Council of State and the drafting of secondary regulations covering detention standards, reception conditions and data-sharing. Several opposition parties and rights groups have signalled their intention to challenge elements of the law—particularly new limits on family reunification—in the courts. Nevertheless, barring unforeseen delays, the government aims to commence the Act no later than June 12, giving agencies and stakeholders less than two months to adapt to an entirely new asylum landscape.
