AFP charges Sudan-born man in Victoria over electronic-monitoring visa breach
The Australian Federal Police (AFP) confirmed that a 39-year-old Sudan-born permanent visa holder was remanded in custody on 6 February after allegedly failing to comply with electronic-monitoring conditions attached to his Commonwealth visa. Victoria Police located the man the previous evening and transferred him to AFP custody.

Under section 76D(3) of the Migration Act 1958, visa holders subject to electronic tracking must keep the device charged and report any malfunction. Breach of the condition carries a maximum of five years’ imprisonment and a $99,000 fine. The AFP alleges the individual deliberately disabled the tracker, triggering an alert with the national monitoring centre.

The case is the latest in a series of enforcement actions following High Court rulings that allowed previously detained non-citizens to be released into the community under strict visa conditions. Since November, the AFP has pursued more than 20 similar matters across three states.
