Austria’s long-overdue effort to bring its child-protection rules for refugee minors in line with EU standards has run into fierce provincial resistance. Late on 30 March, the Freedom Party (FPÖ) governments in Lower Austria, Salzburg and Styria issued a joint statement rejecting the federal Justice Ministry’s draft law that would grant unaccompanied asylum-seeking children full state custody (“Obsorge”) from the first day of their procedure. At present, guardianship is normally transferred to the provincial child-and-youth-welfare offices only after a sometimes month-long court process. During that gap, many teenagers are housed in adult facilities with limited access to schooling, trauma counselling or legal support. The ministry argues that immediate custody would close a “dangerous protection vacuum” and transpose an EU directive that requires guardianship within 15 days.

The FPÖ, however, called the draft “legally excessive and politically reckless”. Lower Austria’s asylum councillor Martin Antauer claimed that earlier custody would force his province—home to the Traiskirchen federal reception centre—to absorb the heaviest burden. The party warns of “double structures, millions in extra costs and unresolved age-assessment disputes”, and insists that responsibility should remain with the federal Basic Services Agency until a court rules on the case. NGOs supporting refugee children welcomed the ministry’s proposal, noting that Austria was repeatedly criticised by UN bodies for delaying guardianship. They stress that most neighbouring EU states already apply custody from day one and that costs are offset by shorter procedures and better integration outcomes.
