Australian Federal Police (AFP) officers in Perth have charged a 34-year-old Sudan-born permanent resident for repeatedly failing to keep the battery of his court-ordered electronic ankle monitor charged—an offence under section 76D(3) of the Migration Act 1958. According to the AFP’s 7 November media release, the man ignored multiple low-battery alerts between 1 September and 13 October 2025, leaving authorities unable to confirm his whereabouts for extended periods.

The defendant was served with a summons on 5 November and appeared in the Perth Magistrates Court on 7 November. Prosecutors told the court that electronic monitoring is a key risk-management tool for non-citizens released from detention who are awaiting deportation or the outcome of appeals. Breaching a monitoring condition carries a maximum penalty of five years’ imprisonment or a A$99,000 fine.
