Late on 14 November, the House of Lords completed its line-by-line scrutiny of the Border Security, Asylum and Immigration Bill and scheduled the third-reading vote for Monday, 17 November. The 345-page Bill is the legislative vehicle that underpins the Government’s wider “less in, more out” strategy, combining tougher criminal penalties for people-smuggling with new powers for Border Force to collect advance passenger data, search vessels in UK territorial waters and fast-track deportations after failed appeals.

For global-mobility managers the headline clause is Part 4, which requires carriers (airlines, ferry and rail operators) to transmit API (Advance Passenger Information) 48 hours before departure instead of the current 24 hours. Airlines that fail to supply complete datasets face civil penalties of up to £50,000 per flight—raising the stakes for travel-risk compliance teams.

The Bill also aligns civil penalty rates for illegal working with HMRC’s maximum tax penalties, doubling fines on employers who negligently hire people without valid right-to-work documentation. HR teams will need to upgrade audit trails for short-term business visitors and contractors.

Peers did not table major amendments at committee, signalling that the Opposition will focus its fire in the Commons. However, the Lords pressed ministers to publish an implementation timetable so that carriers and employers can adapt IT systems before the new API windows and penalty regime go live—expected in summer 2026.

Assuming the Bill passes unchanged next week, companies should start mapping data-flows against the forthcoming law and refresh staff-screening procedures, especially for frequent cross-Channel shuttle and private-jet operations.
